Condizioni Generali di Garanzia
GENERAL WARRANTY CONDITIONS
GENERALITIES
-
The hardware products provided by CJB come from our production center and/or from manufacturers regulated by strict quality standards.
-
If the product, at the time of receipt, has any visible defects, please contact CJB immediately by calling Technical Support (Email: techservice(@)cjb(.)it).
-
CJB may replace the product only if the product is returned within 7 days from the date of receipt. After this period, any possible replacement is at the sole discretion of CJB or, secondly, of the parent company that supplies the product to CJB.
-
In any case, the replacement of the product is possible only if the original packaging is intact and if the product has not been damaged.
-
“Improper use” of the product refers to usage such that the defect is caused by connections to equipment external to the product itself and not by defects related to the product itself.
-
The products are generally guaranteed to operate from 0Âş to 50Âş Celsius (ÂşC) unless otherwise specified (see the relevant user manuals), so operation outside of this range is not guaranteed.
-
The PC product is supplied with/without DIMM or SIMM or DDR, with/without processor, with/without cooling fan, with/without Flash or DOM, according to the customer’s supply requests.
-
It is not possible to guarantee that—in the event of defects found in your tests—CJB will be able to reconstruct the exact same situation that caused the defect in your environment or a behavior that you recognize as a defect of the board.
-
CJB tests the boards received for repair in its laboratories before sending them to the parent company to verify if the reported failure corresponds to what has been reported.
-
It is therefore important that, without exception, all products returned to CJB include a detailed description of the problem encountered, and a description of the operating conditions under which you detected the defect.
-
The lack of such an accurate description will cause a delay in processing the estimate and/or the repair, and generally an additional cost.
-
In any case, CJB assumes no responsibility for damage to persons and/or things resulting from the use, proper and/or improper, of its products.
HOW TO RETURN THE PRODUCT TO CJB FOR REPAIR
A) Request for RMA (Return Material Authorization)
a. By accessing our website (www.cjb.it), on the REPAIR MANAGEMENT page, you must complete a request form for RMA (Return Material Authorization) number.
b. The RMA request form must be completed and sent INDIVIDUALLY FOR EACH RETURNED PRODUCT: that is, one returned product → one RMA.
c. If you send the complete product with accessories such as RAM or processor or others, please clearly indicate this in the description of the product to be returned.
d. CJB will associate an official RMA number with each RMA request form received, which will then be sent to the email address you specified in the form itself. The NAR MUST NEVER BE MODIFIED BY THE CUSTOMER. Take note of the RMA for each product. You can print a copy of the RMA form provided by CJB and attach the printout to the returned product.
B) Shipping the Product(s) to CJB
a. You do not need to return the product with cables, manuals, accessories, but only the essential product. That is, only the board, or the chassis, etc.
b. Do not include cables, manuals, disks, accessories along with the board unless these have been expressly requested by CJB.
c. We will assume no responsibility for the handling of accessory parts.
WARNING!
You should only return accessory parts if authorized and/or specifically requested by CJB. Keep all packaging accessories with you.
WARNING!
Returns FOR REPLACEMENT, for which you will need to return the product in the original packaging, in perfect condition, are an exception. Naturally, the replacement must be pre-authorized by CJB.
d. Carefully pack the product for shipment. You can use the original boxes, even when shipping only the board (see above). However, we recommend placing them in larger packages and not shipping them directly. Especially if they are RETURNS FOR REPLACEMENT. Shipping the product in the original box alone does not guarantee the integrity of the shipment.
e. In the lines of your DDT (Delivery Document), always indicate, FOR EACH RETURNED PRODUCT:
- The CJB serial number or the Original Serial Number of the product (as specified in the RMA Request Form)
- The RMA number we provided for each product.
f. You must indicate the product without naming errors.
g. The reason for the transport must always be: RETURN for REPAIR. Even if there will later be a possible replacement. DO NOT indicate "Return for Repair under Warranty" in advance: the validity of the Warranty at the time of return will be verified and communicated by CJB.
WARNING!
Other indicated reasons, different from RETURN for REPAIR, will cause the package to be rejected upon arrival at CJB.
WARNING!
Also, in the absence of RMA indication in the lines of the DDT, the package will be rejected.
h. THE MATERIAL MUST ALWAYS ARRIVE AT CJB FREIGHT COLLECT, unless there are other agreements.
WARNING!
Material arriving freight assigned will be rejected, unless otherwise agreed.
i. AFTER REPAIR AND/OR REPLACEMENT, CJB WILL RETURN THE PRODUCTS FREIGHT COLLECT (or freight prepaid if agreements are made in this regard), USING THE COURIER YOU SPECIFIED IN THE FORM or (if freight prepaid) our Courier.
j. IT IS POSSIBLE TO MANAGE SHIPMENTS TO/FROM CJB WITH OTHER METHODS THAT MUST BE ABSOLUTELY AGREED UPON IN ADVANCE BETWEEN THE PARTIES.
NOTES ON SERIAL NUMBER MANAGEMENT
Every provided product has a unique serial number. CJB adopts TWO complementary methods:
-
CJB LABELS
In this case, a "proprietary" numbering is applied with an adhesive label that typically states the year of production and the CJB serial number (e.g., 20110543 → this is product No. 0543 of 2011). When there is a label affixed by CJB, that serial number is the only valid one, even if there are other labels and/or writings on the product. Typically, our labels are applied when "kits" are provided for which each component is prepared and tested, or for small supply batches, and almost always to identify RAM, Processors, various accessories. -
ORIGINAL SERIAL NUMBER
In the case of supplies in large batches, the boards are not labeled, but a "mapping" procedure is adopted. In this case, you will NOT FIND the CJB label on the product. Instead, the original manufacturer’s serial number (e.g., TR0AM05001245 or similar) is left, which is typically associated with a BARCODE on the board itself. When CJB prepares these batches, each product is identified with a laser reader. Note that every box in the ORIGINAL packaging has the SAME barcode on the outside that identifies the product inside. In preparing the sales DDT, CJB records all scanned barcodes in a special file, which are then associated with the shipping DDT.
When you receive the DDT, you will NOT see all the barcodes mentioned on it (there wouldn’t be, generally, space) but you will see CJB MAPPING SERIAL NUMBERS that look very similar to those used for the labels: e.g., 201110321 etc. Typically, these Mapping Numbers range from 10,000 onward.
With the supplied batch, if requested, you will receive a PRINTOUT of the mapping, where you will find the association between the DDT and all the barcodes of the products supplied. It will be your responsibility to request and archive these documents, as they are the ONLY ones you will have for your product traceability.
WARNING!
Remember that if you need to return a product and do not find the CJB label, the product was probably supplied in large batches and is therefore managed by mapping. So you will need to indicate the original serial number found on the original label-barcode.
WARNING!
Unfortunately, we have found that many users stick labels or adhesive tapes on which they roughly write the defect, and often place them right over the original label. This is a "convenience" because usually where there is the original label or barcode, there is also space... but this procedure will effectively prevent product traceability and therefore will effectively VOID the warranty.
WARNING!
Products returned with the original barcode damaged are considered out of warranty.
WARNING!
The warranty will only be applied if the product is returned perfectly intact and with the Original NAR Report attached, as described earlier.
PRODUCT INTEGRITY
Products with connectors and/or other devices dirty with glue and/or silicone or other may be repaired but never replaced. If you think of "fixing" connectors and/or jumpers with glue and/or other sealants, be aware that this operation invalidates the Warranty.
TESTING AND TESTING OF PRODUCTS IN CJB
CJB may perform tests on products to determine their functionality. The product will be tested in a situation as similar as possible to your use: for this reason, it will be your responsibility to always indicate the mode of use of the product, specifying: processor, frequency, RAM, type LCD, operating system.
WARNING!
It may also be possible for CJB, at your request, to test the "kit" with the components you provided, including any of your add-on boards not supplied by us, but this will always incur a flat fee that will be charged, regardless of the outcome of the inspection. In this case, all components must be perfectly installed, and ALL necessary connection and power cables must be provided. You will also need to provide all support (hardware and software) for the correct test to be performed. Be aware that we will conduct standard tests REMOVING all accessory boards from the system.
HOW WE TEST PRODUCTS
Testing at CJB is conducted both at room temperature (from 20 to 25 degrees) and at higher temperatures. In any case, we will respect the specifications of the processors used, always inserting the fan where necessary. We will test using an Operating System suitable for the Customer's application. The system is always installed on a certified passive backplane (ISA or ISAPCI or PISA or PCI), except for embedded boards like Mini-ITX or similar, which are standalone. The system may be powered in AT or ATX mode as appropriate.
At the end of the tests, we are able to divide the products into two categories:
- products that after the above tests and any repairs and/or adjustments are found to be perfectly functional
- products that need to be returned to the parent company
In both cases, you will be notified. Be aware that very often, returns of "defective" products that are found to be perfectly functional in CJB are due to incorrect jumpers, wrong CMOS setup, incorrect BIOS, etc.
WARNING!
Unless individually discussed cases, CJB will charge a flat retesting fee for all products returned as "defective" that are verified to be perfectly functional in CJB and/or in the parent company after undergoing the previously described test. This fee will be added to any charge applied by the parent company if the material is sent (for functionality certification) to the parent company.
THIS IS A CASE FAR FROM INFREQUENT. Very often materials are returned WITHOUT any description of the fault, other than "Does Not Work" or similar wording. When CJB receives material with this description, we are obliged to retest it. Often the material is found to be perfectly functional according to our tests (e.g., incorrect jumpers or similar problems). In case of doubt, we send it to the parent company. And often the parent company also returns the material - which is found to be perfectly functional - charging the retesting fees. All these costs will be charged to you.
A FLAT FEE WILL ALSO BE CHARGED if a product is returned without any description of the fault. This is to compensate for the time needed to "find" and understand the fault that was not reported.
DIMM & SIMM DRAM MEMORY, PROCESSORS
Memories and processors are rarely provided by the manufacturer, except in some cases where they are already soldered on board, or provided as kits from CJB, and thus individually checked and tested. Even when CJB provides such kits, it is not possible to recreate in our laboratories the stress conditions to which these components will later be subjected. Our choice is therefore to operate exclusively with reliable suppliers, selecting original and guaranteed products. If one of these components is found to be defective, we can replace it only if returned within 7 days of receipt of the material at your location. We always recommend performing tests on received materials and reporting any anomalies within 7 days. When we receive such defective parts (naturally, the return procedure with RMA described above must be followed), they may be replaced.
TIMING
Products returned to CJB are inspected by our Technicians upon receipt. If repairable, the repair is carried out as quickly as possible, and the product will be returned to you (apart from any communication and acceptance procedures, by you, for expensive repairs). If CJB deems the product repairable, but this cannot be repaired at CJB, the product will be sent to the parent company. Typically, parent companies carry out repairs within 6-8 working weeks. We recommend NOT waiting to send us defective and/or faulty products: you will only waste time on the duration of the Warranty.
"READY REPAIRED" AND STORAGE
Products repaired at a charge, for which we have received your approval for the estimate, are confirmed "READY REPAIRED" and you will receive a final summary informing you that the product will be shipped back or you can pick it up as soon as the repair is paid.
IF THE MATERIAL IS NOT COLLECTED WITHIN 4 WEEKS FROM THE SENDING OF THE SUMMARY, AN EXTRA STORAGE COST WILL BE APPLIED FOR EACH WEEK OF STORAGE.
WARRANTY LIMITATIONS
The Warranty is limited to the Warranty conditions of our Suppliers. In particular for mass storage memory supports, such as HDD, FDD, CDROM, CDRW, DVD and anything else, which are subject to wear, repair and/or replacement are subject to prior approval by our Suppliers.
WARNING!
LCD cables, micro-connection cables, micro-LCD connectors, and similar items are NOT covered by Warranty. Such products are always tested in CJB with maximum attention and care. We recommend handling them with equal attention and care: only in this way will you not have usage problems.
FLASH SUPPORTS
All FLASH supports (DiskOnChip, DiskOnModule, SmartMedia, CompactFlash, CFast, SSD, etc.) experience wear due to use. For these devices, a possible replacement will only be possible if they are returned within 7 days of receipt, and in any case, the returned device will be subject to examination by the parent company, which will communicate whether the defect is due to improper use and/or wear or origin defects. Contact CJB Technical Service for further information (techservice(@)cjb(.)it).
SOFTWARE WARRANTY
The warranty and assistance conditions on software products, packaged and/or custom, are those defined contractually at the time of supply. If the conditions are not defined in advance, they are governed by the following regulations.
LICENSE AGREEMENT FOR USE OF CJB COMPUTER JOB SOFTWARE PRODUCTS (excerpt)
CJB grants the Customer, who accepts, a non-exclusive and non-transferable license to use the CJB Software Product (or CJB Software Products) identified (or identified) in the Appendix of the Agreement, according to the terms and conditions described in the following articles. (NOTE: hereafter, the "CJB Software Product" or "CJB Software Products" will be briefly referred to as "CJB Program")
-
DEFINITION
The term "Program" as used in the contract refers to the set of information readable by the computer on magnetic media, CDROM, DVDROM, FlashDisk, etc., the related user documentation, and any other accessory materials related to the Program (e.g., programmed EPROM/ROM/Flash memories), all provided to the Customer by CJB or on its behalf. For brevity, we will also define "Program" as the set of multiple Programs that operate independently of one another if provided on multiple media. -
OWNERSHIP
The Program, as well as its Copyright and any other intellectual or industrial property rights, are the property of CJB or its third-party licensors and are to be considered trade secrets of CJB. The Customer does not acquire any title or right to the Program, except for the License to Use granted with the Agreement. -
CONFIDENTIALITY
The Program is provided to the Customer in a confidential form, and the Customer is responsible for taking all necessary precautions to ensure the confidentiality of the Program is maintained. In particular, the Customer will keep the program confidential and will not disclose or make it available to third parties (except to the Customer's employees, but only for the permitted use according to this Agreement), without the prior written consent of CJB. The Customer may not remove or in any way delete from the Program or the related support or packaging any trademark, trade name, copyright notice, or other notice of reservation of rights affixed there, and is responsible for their maintenance on the copy of the Program received from CJB, and for their reproduction on working or backup copies of the Program made by the Customer as well as on any parts of the Program incorporated by the Customer into other programs according to the provisions of Art.4. -
LICENSE
-
For the purposes of this Agreement, "use of the Program" means the partial or total copying of the instructions and data contained in the Program by transferring or reading from a magnetic medium, and introducing them into a computer owned by the Customer in order to process the Customer's data.
-
The License granted herein takes two different forms, depending on whether the Program is provided with or without documentation in Source format.
Programs provided with Documentation in Source format
The Program in source format, if included in the supply, is provided by CJB to the Customer solely for the purpose of allowing the Customer, through access to the source documentation, to have a complete view of the software product they are using. Consequently, the Customer has the right to use the sources only for internal consultation purposes, and it is expressly forbidden to disclose to third parties the contents of the source documentation.
The Customer, through appropriate inclusions of the CJB Program in their User Program, may generate OBJECT FORMAT applications that contain parts (or all) of the CJB Program. The Customer may not, in whole or in part, include the source documentation of the CJB Program in source format documentation, supported by any means (magnetic disks, printed paper, etc.), that must then be provided to third parties. No one other than the licensed Customer may possess the source documentation of the CJB Program in any form.
If the Customer develops their own User Program that includes parts (or all) of the CJB Program in exclusively OBJECT format, the Customer may provide such User Program they have developed to third parties without any royalty obligation towards CJB. The source documentation provided is to be considered compatible exclusively with the development tools (e.g., Cross-Compilers, etc.) specifically indicated in the catalog of CJB software products.
The Customer is allowed to modify, in whole or in part, the source documentation they have purchased (e.g., to adapt it for different compilers or h/w and s/w systems). The modified documentation is still considered to be the property of CJB and is subject to our License to Use. The Customer may copy, in whole or in part, the Program in a machine-readable format onto another magnetic medium, either alone or incorporated into other licensed Programs for use on the Designated Computer, solely for the purpose of having a backup copy to prevent the loss of information from the Program in case of malfunctions. This copy will be subject to the conditions of the Agreement.
If the Program is an "Upgrade" of another CJB Program product, the license granted to the Customer under the Agreement is contingent upon the existence of a valid prior license previously granted by CJB to the Customer for the use of that CJB Program, and if that prior License ceases for any reason, the License to use the Program granted under the Agreement will also cease on the same date. The source Program and the logical (or design) documentation are never considered accessory materials of the Program provided in only executable form and are not provided to the Customer or licensed for use under this Agreement.
Under the granted License, the Customer has the right to use the Program only on a single computer; Programs provided with a royalty obligation (e.g., OS licenses or Real-Time tool licenses) may not be duplicated without prior regularization of the supply.
The Customer may also incorporate the Program into other programs licensed to the Customer, provided that any part of the Program so incorporated will continue to be subject to the terms and conditions of the Agreement. As the only exception, see the next point.
If the CJB Program is a collection of modules in object format ("Library"), and is provided in "unlimited use license" version, as the only exception to the above, the Customer may use the modules in whole or in part to include them in their own User Programs intended for use even on different Computers (e.g., third-party computers, which are in turn Customers of the Customer). In this case, the Customer is not required to pay any royalty for the use of the CJB Program. Except as stated above, the Customer may not make any other use of the Program without the prior written consent of CJB.
The Customer may copy, in whole or in part, the Program in a machine-readable format onto another support, either alone or incorporated into other Programs licensed to the Customer for use on the Designated Computer, solely for the purpose of having a backup copy to prevent loss of information from the Program in case of malfunctions. This copy will be subject to the conditions of the Agreement and may only be used on one PC. Some programs, however, may include mechanisms and/or hardware and/or software devices to limit or inhibit copying (e.g., hardware protection keys).
The Customer may not reproduce, even partially, the user documentation of the Program and any other documentation provided to the Customer by CJB or by third parties on its behalf. Additional copies of such documentation may be provided to the Customer, upon written request, by CJB at the costs in effect at the time of the request. If the Program is an "Upgrade" of another CJB Program product, the license granted to the Customer under the Agreement is contingent upon the existence of a valid prior license previously granted by CJB to the Customer for the use of that specific CJB Program on the designated processing unit (PC). If that prior License ceases for any reason, the License to use the Program granted under the Agreement will also cease on the same date.
-
EFFECTIVENESS; DURATION
The contract comes into force from the date of receipt by the Customer of the CJB Program and remains in effect until it is terminated by CJB as provided in Article 8. -
EXCLUSION OF WARRANTIES - LIMITS OF LIABILITY
CJB does not provide the Customer with any warranty on the Program licensed herein, and any implied warranty, including the warranty of fitness for particular purposes, is expressly excluded. IN NO EVENT WILL CJB OR ITS LICENSORS BE LIABLE FOR INDIRECT DAMAGES TO PERSONS AND/OR PROPERTY. -
TRANSFER
The Agreement and the License granted to the Customer may not be assigned, sublicensed, or otherwise transferred by the Customer to third parties without the prior written consent of CJB. CJB may assign and/or transfer its rights and obligations under the Agreement to the potential supplier of the Program, in the case of a non-original CJB Program that is simply distributed by CJB (e.g., Compilers and other software tools). -
TERMINATION OF THE CONTRACT
In addition to the termination provisions of the License provided in Article 4, the Agreement and the licenses granted may be terminated immediately by CJB by written notice to the Customer in the following cases: in the event of the Customer's failure to comply with any of its obligations under this agreement; in the event of termination of the Agreement between CJB and the Customer for the sale or lease of the PC on which the Program is installed, if the Customer has purchased or leased that PC from CJB; in the event of the Customer's failure to timely pay amounts due to CJB or its licensors, in exchange for the delivery of the Program and the related License to Use.
All actions that CJB deems appropriate to take against the Customer to recover overdue fees and/or any other damages suffered are reserved. Upon termination of the Agreement and the granted license, the Customer shall cease any further use of the Program, and CJB may request both the destruction of the Program in any form in the Customer's possession and its return to CJB. In any case, the provisions of Article 3 (Confidentiality) will remain in effect despite the termination of the Agreement.
-
EXPORT RESTRICTIONS
The Customer acknowledges and agrees that the Program licensed under this Agreement may be of USA origin (e.g., Compilers) and thus subject to certain restrictions regarding its export according to international agreements with the US government. Therefore, without prejudice to the provisions of Article 4) (License), the Customer agrees not to export the Program or any technical information received under this Agreement to countries other than the United States of America or the member countries of the European Community, without the prior written consent of CJB. -
FINAL CLAUSE
No modification and/or addition to the Agreement will be binding on the parties unless specifically approved in writing by both parties.
